Phase 1 report real estate “reliance letter” in California is issued by ALFA's Environmental Professional (EP) {40 CFR Part 312}. A Phase 1 ESA Reliance Letter is attached to the Phase 1 Environmental Site Assessment Report. A reliance letter grants legal ability for other parties such as Banks, SBA, investors, and/or lenders to use and rely on an existing Phase 1 ESA report. A Reliance Letter is used for SBA environmental due diligence, a reliance letter is required for the Transaction Screen and for Phase I and II Environmental Site Assessments. The reliance letter is viewed as a type of insurance or guarantee that that property is not contaminated.
In a Reliance Letter the Consultant recognizes that the Bank, SBA, investor(s), and/or lender(s) will utilize the Report for the purposes of assessing the environmental risk inherent in the contemplated financing of the Site. By a Reliance Letter the Consultant certifies that the Report was prepared in accordance with the due diligence practices as delineated by the ASTM International (ASTM) “Standard Practice for Environmental Site Assessments: Phase I Environmental Risk Assessment Process” (E 1527-05)

Common uses where environmental concerns are found in a Phase 1 Environmental report include: service stations, manufacturing facilities, dry cleaners,
industrial sites, auto repair, oil and gas well drilling and production, former agricultural crops, refineries, gas underground storage tanks (UST), other sites with releases of chemicals into the subsurface.
When an environmental issue is found in the Phase 1 Environmental Assessment, it will typically trigger a Phase 2 Study or Phase II ( 2 )
